Terms governing use of the Aghosh UK website and related services

Last updated: 28 August 2026

1.About Aghosh UK

These terms apply to the use of the Aghosh UK website, online donation facilities and related online services.

The website is operated by:

Aghosh UK

254A Bury New Road

Whitefield

Manchester

M45 8QN

United Kingdom

Email: [email protected]

Telephone: 0161 526 3307

References to “Aghosh UK”, “we”, “us” or “our” mean Aghosh UK.

2.Acceptance of these terms

By using our website, you agree to these terms. If you make a donation, register for an event, volunteer, fundraise or use another service, additional terms displayed at the relevant point may also apply.

If additional terms conflict with these general terms, the specific terms will take priority for that activity.

If you do not agree to these terms, you should not use the website.

Nothing in these terms limits rights or remedies that cannot legally be limited.

3.Website information

We take reasonable care to keep website information accurate and current. However:

4. charitable programmes and emergency situations can change quickly;

5. project costs and delivery times may be affected by access, security, weather, exchange rates, regulation, local conditions and other factors;

6. images and case studies may illustrate the type of work supported rather than the exact person or project funded by a particular donation; and

7. general website information is not legal, tax, financial, medical or religious advice.

You should obtain appropriate professional or religious advice where relevant to your circumstances.

We may correct errors or update information without notice. Material corrections affecting a donation will be handled fairly and in accordance with charity law.

8.Donations

Making a donation

You must be legally entitled to use the payment method provided and ensure that the information submitted is accurate.

Online donations are normally processed in pounds sterling. Your bank or payment provider may apply currency-conversion charges or other fees.

A donation is not complete until the payment provider confirms successful processing. We may refuse or return a donation where permitted by law and where the trustees or their properly authorised delegates decide that doing so is in the charity’s best interests.

Unrestricted donations

If an appeal is described as unrestricted, or no specific restriction is accepted, the donation may be used where Aghosh UK’s trustees consider it will most effectively further the charity’s objects.

Restricted appeals

Where we expressly accept a donation for a restricted charitable purpose, we will apply it to that purpose in accordance with charity law.

An appeal page may describe a sufficiently broad secondary purpose that applies if the original purpose is fully funded, becomes impossible or impracticable, or cannot use all the funds raised. Any such secondary purpose will be communicated before the donation is completed.

If a restricted appeal fails and no valid secondary purpose applies, the trustees will follow the applicable legal process. Depending on the circumstances, this may involve contacting donors, offering a return, applying funds under charity-law rules or seeking authority from the Charity Commission.

Restricted donations will not be redirected merely for administrative convenience.

Programme delivery and allocations

Unless an appeal expressly promises that a particular donation will fund a specific identifiable item or beneficiary, donations may be pooled with other funds for the relevant charitable purpose.

We may adapt the method, location or timing of delivery where reasonably necessary, provided that restricted funds continue to be applied consistently with their charitable purpose and the representations made to donors.

Reasonable programme, governance, compliance, monitoring, fundraising and support costs may be met from donations where legally permitted and consistent with the relevant appeal representation.

Zakat and other Islamic giving

Where an appeal is identified as eligible for Zakat or another particular form of Islamic giving, we will seek to administer the donation consistently with the description provided on the appeal page and our applicable charitable procedures.

Donors remain responsible for deciding whether a donation satisfies their personal religious obligations. Website information is general and should not be treated as a personal religious ruling. Donors should seek advice from a suitably qualified adviser if uncertain.

We will treat information revealing religious practices or beliefs in accordance with our Privacy Notice and applicable data-protection law.

Gift Aid

If you make a valid Gift Aid declaration, you confirm that:

9. you are eligible for Gift Aid;

10. you understand the tax statement presented with the declaration; and

11. you will notify us if your name, address or tax circumstances change or if you wish to cancel the declaration.

You are responsible for paying enough UK Income Tax and/or Capital Gains Tax to cover the Gift Aid claimed by all charities on your donations for the relevant period. If insufficient tax has been paid, HMRC may require you to pay the difference.

We may contact you where reasonably necessary to administer or verify Gift Aid.

Regular donations

Regular donations continue according to the frequency and payment instruction selected until cancelled, the payment authority expires or the arrangement otherwise ends.

You may cancel a recurring donation by contacting us and, where applicable, your bank or payment provider. Cancellation does not reverse payments already properly collected.

Direct Debit donations are also protected by the applicable Direct Debit Guarantee.

Payment providers

Payments may be handled by independent banks, card processors, Direct Debit providers or fundraising platforms. Their terms may also apply.

We are not responsible for a provider’s separate charges, exchange rates or service interruption, except to the extent that responsibility cannot legally be excluded.

12. Refunds and donation errors

Charitable donations are not generally purchases and do not carry a general cooling-off right.

We will consider refund requests in accordance with charity law, our refund policy and the Code of Fundraising Practice. A refund may be appropriate where, for example:

13. a duplicate donation was made by mistake;

14. an incorrect amount was entered;

15. a payment was unauthorised;

16. a donor correctly exercises a legal right to a refund; or

17. another exceptional circumstance justifies a refund and Aghosh UK has the legal power to make it.

Please contact [email protected] as soon as possible with the transaction date, amount and reason for the request.

We may request evidence reasonably needed to verify the payment. Approved refunds will normally be returned using the original payment method. Any Gift Aid claim or related tax record will be corrected where required.

A refund cannot be promised merely because a donor changes their mind. Trustees must ensure that returning charitable funds is lawful and in the charity’s best interests.

18.Fundraising on behalf of Aghosh UK

You must obtain any approval required by Aghosh UK before presenting yourself as an authorised representative or using our name or logo for a fundraising activity.

Unless we confirm otherwise in writing, an independent fundraiser acts in support of Aghosh UK and is not our employee, agent or authorised spokesperson.

Fundraisers must:

19. act legally, honestly, openly and respectfully;

20. describe the fundraising purpose accurately;

21. protect donor information;

22. obtain required permissions, licences and insurance;

23. follow applicable safeguarding and health-and-safety requirements;

24. keep accurate financial records;

25. transfer funds promptly; and

26. not deduct expenses from donations unless this has been clearly disclosed and properly authorised.

Additional fundraising or event terms may apply.

27.Events, volunteering and services

Registration for an event, challenge, volunteering opportunity or programme may be subject to separate eligibility, conduct, safeguarding, cancellation, health, travel or fundraising requirements.

We may refuse or cancel participation where reasonably necessary for safety, safeguarding, legal compliance or the proper operation of the activity.

Where we cancel a paid event or service, the specific event terms will explain whether a payment is refundable, transferable or capable of being converted into a donation.

28.Acceptable website use

You must not:

29. use the website unlawfully or fraudulently;

30. attempt to gain unauthorised access to the website, accounts, databases or servers;

31. introduce malware or harmful code;

32. interfere with the website’s operation or security;

33. scrape or extract personal information without permission;

34. impersonate Aghosh UK, its staff or its representatives;

35. use our content in a misleading fundraising appeal;

36. submit material that is defamatory, threatening, discriminatory, obscene or unlawful; or

37. infringe another person’s intellectual-property, privacy or other rights.

We may restrict or block access where reasonably necessary to protect users, Aghosh UK or its systems.

38.User-submitted content

If you submit a comment, fundraising story, photograph, video or other material, you confirm that:

39. you have the right to provide it;

40. its use will not infringe another person’s rights;

41. you have obtained appropriate permission from identifiable people; and

42. information concerning children or vulnerable people has been handled appropriately.

You retain ownership of your content. You grant Aghosh UK a non-exclusive, royalty-free licence to use it for the purpose for which it was submitted and explained to you.

We will obtain clear and informed permission before publishing an identifiable case study, where required by law or the Code of Fundraising Practice.

43.Intellectual property

Unless otherwise stated, the website and its original content, branding, graphics and design belong to Aghosh UK or are used under licence.

You may view and print reasonable extracts for personal, educational or non-commercial use, provided that you:

44. do not materially alter the content;

45. acknowledge Aghosh UK as the source;

46. do not imply our endorsement; and

47. do not remove copyright or ownership notices.

Our name, logo or campaign materials must not be used for commercial fundraising, advertising or endorsement without written permission.

48.External websites and platforms

Our website may link to third-party websites, social-media services, payment providers or fundraising platforms.

Links are provided for convenience and do not necessarily constitute endorsement. Third parties control their own services, availability, security, content and privacy practices.

You should review their applicable terms and privacy information.

49.Privacy and cookies

Personal information is handled in accordance with our Privacy Notice.

Our use of cookies and similar technologies is explained in our Cookie Notice and cookie settings. Non-essential cookies will only be used where the applicable consent requirements are met.

The Privacy Notice is separate from these terms and does not form a contractual waiver of your data-protection rights.

50.Fundraising and marketing communications

Where permitted by law, we may send information about our charitable work, campaigns, appeals, events and volunteering opportunities.

Electronic communications may be sent with consent or under the charitable-purposes soft opt-in where all legal requirements are satisfied.

Every marketing email or text will provide an appropriate way to opt out. You may also contact [email protected].

Opting out of marketing does not prevent service messages reasonably necessary to process a donation, provide a receipt, administer Gift Aid, respond to an enquiry or communicate important information about an activity for which you registered.

51.Website availability and security

We aim to keep the website available and secure, but we do not guarantee uninterrupted or error-free access.

We may suspend or restrict the website for maintenance, security, legal or operational reasons. You are responsible for using appropriate security measures on your own device and internet connection.

52.Liability

Nothing in these terms excludes or limits liability for:

53. death or personal injury caused by negligence;

54. fraud or fraudulent misrepresentation;

55. breach of a duty that cannot legally be excluded; or

56. any other liability that cannot be limited under applicable law.

Subject to those protections, Aghosh UK is not responsible for losses caused by:

57. circumstances outside our reasonable control;

58. a user’s unlawful or unauthorised conduct;

59. inaccurate information supplied by a user;

60. independent third-party websites or services; or

61. failure to follow these terms or relevant instructions.

If you use the website as a consumer, your statutory rights are unaffected.

62.Complaints

If you have a complaint about a donation, fundraising activity, website content or our service, contact:

Aghosh UK

254A Bury New Road

Whitefield

Manchester

M45 8QN

United Kingdom

Email: [email protected]

Telephone: 0161 526 3307

We will acknowledge and investigate complaints in accordance with our published procedures. If a fundraising complaint is not resolved, you may be able to refer it to the Fundraising Regulator.

Data-protection complaints are handled under the complaints section of our Privacy Notice. You also have the right to complain to the Information Commissioner’s Office.

63.Changes to these terms

We may amend these terms to reflect legal, regulatory, operational or website changes.

The updated version will be published with a revised date. A change will not retrospectively remove a donor’s legal rights or alter an accepted restriction on a donation.

Where a change materially affects an ongoing service or arrangement, we will provide additional notice where appropriate.

64.Severability

If any part of these terms is found to be unlawful or unenforceable, the remaining provisions will continue to apply.

A failure to enforce a provision immediately does not waive our right to enforce it later.

65.Governing law

These terms are governed by the law of England and Wales.

The courts of England and Wales will have jurisdiction, subject to any mandatory right a consumer has to bring proceedings elsewhere in the United Kingdom.
